What the Homebuyers Privacy Protection Act Means for You: Protecting Your Personal Info During the Mortgage Process

In the digital age, privacy is more important than ever, especially when you’re sharing sensitive financial and personal information to buy a home. That’s where the Homebuyers Privacy Protection Act (HPPA) comes in.

This new legislation is a big win for homebuyers. If you’re thinking about purchasing a home, here’s what you need to know about how the HPPA works and how it protects you throughout the mortgage process.

What Is the Homebuyers Privacy Protection Act?

The Homebuyers Privacy Protection Act is a federal law that was just passed by Congress, and will go into effect in approximately six months.  It is designed to protect homebuyers from unwanted solicitation and safeguard their private data after applying for a mortgage.

When you apply for a mortgage, your credit report is pulled which often triggers a flood of calls, texts, and emails from other lenders who bought your data from credit bureaus. These are called trigger leads.  And YES, it is the credit bureaus – Experian, Equifax, and TransUnion – who sell your information to hundreds of other mortgage lenders.

Under the HPPA, the sale of your personal mortgage-related data, like your phone number, credit score, or lender activity, to third parties without your consent is now prohibited.

Say Goodbye to Trigger Lead Spam

If you’ve ever been inundated with lender solicitations after applying for a mortgage, you’ve experienced trigger lead spam firsthand. This was not only overwhelming, but often misleading or even predatory.

Thanks to the HPPA:

  • Lenders and brokers can no longer buy your data from credit bureaus after you apply for a mortgage.
  • Your personal information stays with the lender you chose, unless you explicitly consent to share it.
  • The law limits how your financial information can be used, adding a layer of transparency and control.

Why This Is Good News for Homebuyers

Here’s how the Homebuyers Privacy Protection Act helps you:

  • Protects your data from being sold without your permission
  • Reduces scam risk from fraudulent or aggressive third-party lenders
  • Lets you focus on your homebuying journey without annoying spam calls
  • Gives you control over who contacts you and when

Buying a home is one of the biggest financial decisions you’ll ever make. You deserve to go through that process without being bombarded by spam calls or worrying about where your information is going.

How to Stay Protected and Informed

Even with the HPPA in place, it’s still important to:

  • Work with a reputable mortgage lender who puts your privacy first.
  • Ask how your data is handled and what safeguards are in place.
  • Be cautious of any unexpected contact from companies you didn’t apply with.
